    Although possession is a remedy of last resort, there are cases when possession action is the only option. We provide a clear assessment of the merits of the case upfront enabling you to decide whether to pursue possession proceedings. We also provide detailed analysis and advice in respect of the Public Sector Equality Duty and proportionality throughout a landlord’s decision making process.

    We regularly advise clients in respect of claims of possession involving tenancy breach, failed succession and abandonment, to name but a few.

    Rent and service charge arrears recovery

    In the current economic climate, it is important to have a rigorous and effective arrears recovery processes. We can assist you with training and provide an efficient legal service when arrears cases need to be referred. 

    Mental health issues

    Our team of lawyers are skilled in dealing with mental health issues, particularly in relation to mental capacity and the ability of tenants to conduct court action independently. We rely on our experienced Health Care and Regulatory team to support our Housing Management lawyers in cases where the Court of Protection may need to be used or where a defendant may be better supported but other agencies, such as Social Care, after time in hospital.

    Gas servicing injunctions

    Landlords regularly encounter problems gaining access to renew CP11 certificates, and there are occasions when an injunction is required. We can support in such cases and can offer a sophisticated online solution to landlords who are seeking injunctions at volume.
