• In light of the UK’s legal commitment to reach Net Zero emissions by 2050, the development of Carbon Capture, Usage and Storage (CCUS) technology and infrastructure is viewed as an essential component to help achieve this. It will involve the development of CCUS clusters with transport and storage networks across the UK acting as the enabling infrastructure for a range of carbon capture projects, including gas power plants, low carbon hydrogen production, bioenergy, energy from waste and direct air capture.

We are at the forefront of the development of CCUS technology in the UK Energy from Waste (EfW) sector, including on both the incorporation of CCUS technology into new EfW plants and the retrofit of CCUS technology into existing EfW facilities. We have the commercial and legal expertise to advise:

    • EfW plant owners and operators
    • Waste management companies
    • CCUS technology providers
    • EfW plant developers
    • investors and funders, and
    • local authorities

on the complex legal and regulatory framework for delivering CCUS, including on the Department for Business, Energy & Industrial Strategy (BEIS) business model for Industrial Carbon Capture (ICC).

Our team of legal specialists can advise clients on:

    • ICC business model and ICC Contracts
    • CCUS funding
    • PFI and PPP projects, including on the Qualifying Change in Law regime
    • Project finance, commercial and energy contracts
    • CCUS construction and engineering contracts
    • UK Emissions Trading (ETS), carbon and emissions matters
    • Land, property and planning issues

     Our experience includes advising:

    • a major UK waste management company on the development of a new 450kpta Energy Recovery Facility with CCUS infrastructure
    • the owner of an existing Energy Recovery Facility on the retro-fit of CCUS infrastructure at their 25MW municipal waste based plant
    • a local authority on the Qualifying Change in Law implications of CCUS infrastructure on their EfW PPP Project
